CHEMICALS INDUSTRY LEGISLATION
We give here some of the main legislation pertaining to companies involved in the handling of chemicals.  There is however much more.

Applicable to suppliers of chemicals in any form and amounts Hazardous substances Act No 15 of 1973.

The Act aims at restricting or controlling the use of toxic substances which may have negative effects on humans health.  It makes provision for the classification of certain substances according to their hazardous rating by the health department and the disposal of hazardous substances.  

 

Occupational Health and Safety Act No 85 of 1993.
The Act provides for the health and safety of persons at work and for the health and safety of persons in connection with the use of plant and machinery and the protection of persons other than persons at work against hazards to health and safety arising out of or in connection with the activities of persons at work. 

 

National Road Traffic Act No 93 of 1996.  Chapter VIII of the Regulations.
Transportation of Dangerous Goods and Substances by road. The Act applies to ALL parties involved in the conveying or distribution of Dangerous Goods for renewal.  All Dangerous Goods listed in SANS 10228:  Classification & Identification of Dangerous Goods fall under this Act.

 

The Non-Proliferation of Weapons of Mass Destruction Act No 87 of 1993.
The Act deals with controlled goods and control measures applicable to such goods.

 

The Drugs and Drug Trafficking Act No 140 of 1992.
The Act governs the possession and sale of certain chemicals and drugs.

 

The Explosive Act No 15 of 2003.
The Act deals with the disposal of explosive waste.

 

Health Act No 63 of 1977.
The Act deals with the threat of waste to human health. 

 

The National Environmental Management Waste Act No 59 of 2008.
Deals with waste management in respect of storage, disposal and transport.
